The value of having a well drafted will that reflects both your intentions and your legal obligations can save your spouse and family and a huge amount time, money and stress after you die however it is often seen as being merely a form filling exercise.

Expensive mistakes in preparation of a Will

Did you know that for a will to be valid there needs to be a statement on the will that the witnesses were present with the will maker when the will was signed?

In a recent case in the High Court in Invercargill a will was considered where this statement had been omitted.  As the will did not comply with the Wills Act the will was found to be invalid.

Are you mentally capable of signing a will?

How do you tell if someone is mentally capable of signing a will? What does the law say?  There is no one standard test to see if anyone has sufficient mental capacity to sign a will or do anything else. In each case it is a matter of looking at what the person wants to do and then assessing their mental ability to do that act at that time.
